Terms of Service

These Terms of Service ("Terms") govern your use of the Spoke mobile application ("App") provided by Spoke ("we", "our", "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Description of Service

Spoke is an AI-powered voice writing assistant that transforms spoken or typed input into polished, natural-sounding text for various formats including emails, social media posts, and messages. The App uses on-device speech recognition and cloud-based AI processing to deliver its services.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Account

• The App creates an anonymous account automatically upon first use. No personal information is required.
• You may optionally sign in with Apple to preserve your data across devices.
• You are responsible for maintaining the security of your device and account.

4. Free and Pro Plans

4.1 Free Plan

• Available to all users at no cost.
• Includes a limited number of daily text rewrites.
• All presets and tone modifiers are available.
• Daily limits reset at midnight UTC.

4.2 Pro Plan

• Available via in-app purchase (monthly or annual subscription).
• Includes unlimited text rewrites and additional features.
• Subscriptions are managed through Apple's App Store and are subject to Apple's terms.

4.3 Referral Program

• Users may invite others using a referral code to receive temporary bonus requests.
• We reserve the right to modify or discontinue the referral program at any time.
• Abuse of the referral system (e.g., creating fake accounts) may result in account suspension.

5. Subscriptions & Billing

• All purchases are processed through Apple's App Store.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your Apple ID account settings.
• Refunds are handled by Apple per their refund policies.
• We reserve the right to change subscription pricing. Existing subscribers will be notified before any price changes take effect.

6. Acceptable Use

You agree not to use the App to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity, or falsely represent your affiliation
• Generate spam, phishing content, or mass unsolicited messages
• Attempt to circumvent usage limits, rate limiting, or other protective measures
• Reverse engineer, decompile, or disassemble the App
• Use the App for any purpose that violates applicable laws or regulations

7. AI-Generated Content

• Content generated by the App is produced by artificial intelligence and may not always be accurate, complete, or appropriate.
• You are solely responsible for reviewing and verifying all generated content before use.
• We do not guarantee the accuracy, quality, or suitability of any generated content.
• You retain ownership of your input content. Generated output is provided for your personal and commercial use.

8. Intellectual Property

• The App, including its design, code, features, and branding, is owned by us and protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes in accordance with these Terms.
• You may not copy, modify, distribute, or create derivative works based on the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, OR PROFITS, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

12. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App. Your continued use of the App after such changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
